Increases in the CJA Hourly Rates and Case Compensation Maximums

Rates for counsel

The hourly rates for CJA appointed counsel have been increased to $164 (non-capital) and $210 (capital).

Non-capital case compensation maximums

The waivable case compensation maximums for counsel have increased as follows:

  • $12,800 (previously $12,300) for a felony
  • $9,100 (previously $8,800) for an appeal
  • $3,600 (previously $3,500) for a misdemeanor
  • $2,700 (previously $2,600) for other (e.g., supervised release, material witness)

The waivable case compensation maximum for services other than counsel (investigator, experts, etc.) when prior authorization is obtained, has increased to $2,800 per provider (excludes expenses). The no-authorization maximum ($900) has not changed.

Effective Date

These changes apply to services furnished on or after January 1, 2023.

Capital Cases

Capital case limits have not changed. Capital cases should be budgeted and are controlled by provisions in the Fifth Circuit’s CJA Plan.
