Increases in the CJA Hourly Rates and Case Compensation Maximums

Rates for counsel
The hourly rates for CJA appointed counsel have been increased to $175 (non-capital) and $223 (capital).

Non-capital case compensation maximums
The waivable case compensation maximums for counsel have increased as follows:

  • $13,600 (previously $13,400) for a felony
  • $9,700 (previously $9,600) for an appeal
  • $3,900 (previously $3,800) for a misdemeanor
  • $2,900 (unchanged) for other (e.g., supervised release, material witness)

Effective Date
These changes apply to services furnished on or after January 1, 2025.

Services other than Counsel
The waivable case compensation maximums for investigators, experts, and other service providers remain unchanged ($3,000 with prior authorization; $1,000 without).

Capital Cases
Capital case limits have not changed. Capital cases should be budgeted and are controlled by provisions in the Fifth Circuit’s CJA Plan.
