Increases in the CJA Hourly Rates and Case Compensation Maximums

Rates for counsel
The hourly rates for CJA appointed counsel have been increased to $158 (non-capital) and $202 (capital). 

The non-capital case compensation maximums have increased as follows:

  • $12,300 (previously $12,100) for a felony
  • $8,800 (previously $8,600) for an appeal
  • $3,500 (previously $3,400) for a misdemeanor
  • $2,600 (unchanged) for other (e.g., supervised release, material witness)

Effective Date
These changes apply to services furnished on or after January 1, 2022.

Capital Case Thresholds
The compensation thresholds that trigger Fifth Circuit review in capital trials and habeas cases ($100,000/$35,000) have been replaced by new provisions in the Fifth Circuit’s CJA Plan.
