Misinterpretation of Pending Civil Caseload Statistics

The Administrative Office of the U.S. Courts (AOUSC) makes certain case statistics available on its website. Please be advised that the pending civil cases reported by the AOUSC include cases that are under a Multidistrict Litigation (MDL) order. Large numbers of civil cases from around the country may be temporarily assigned by the Judicial Panel on Multidistrict Litigation to a district judge for pretrial management, and this would inflate a district’s pending caseload. It is advisable to check with the relevant district court before drawing statistical conclusions about the number of pending cases reported for that district. The Northern District of Texas currently has four pending MDLs. Please see the MDL report here.
